Terms of Service
Last updated: 22 October 2026
These terms are the agreement between you and Fromly. By creating an account you accept them. If you do not accept them, do not use the service.
1. Who we are
Fromly is operated by Fromly, a French micro-entreprise (sole trader). You can reach us at axel.schapmann@gmail.com.
2. What the service does
Fromly is an email marketing tool for software companies. It imports your customers from tools you connect, such as Stripe and Supabase, and lets you send them campaigns and automated emails. Emails are delivered through Amazon SES.
The service is young and still changing. Features may be added, altered or removed. We will not remove something you rely on without telling you first.
3. Your account
You need an account to use Fromly, and you are responsible for what happens under it, including what the people you invite to your workspace do. Keep your sign-in method secure and tell us if you think someone else has access.
You must be at least 18 years old and able to enter into a contract.
4. Sending rules
Everything in this section exists for one reason: one sender’s bad practice damages the deliverability of every other sender. These rules are not negotiable.
You may only email people who asked to hear from you. That means your own users, customers or subscribers. You may not upload lists that were bought, rented, scraped, harvested or obtained from a third party.
You may not use Fromly to send:
- anything unlawful, deceptive, defamatory, or infringing someone else’s rights
- phishing, malware, or messages pretending to come from someone else
- adult content, gambling, get-rich-quick schemes, or multi-level marketing
- unsolicited commercial email of any kind
Every email sent through Fromly carries an unsubscribe link. You may not remove it, hide it, or make it hard to use, and unsubscribes are honoured automatically.
5. How we enforce those rules
Fromly watches bounce and complaint rates while a campaign is being sent, and pauses the campaign by itself when they climb too high. This can happen mid-send, and we do not consider it a service failure.
We may also suspend sending, suspend an account, or close it, when we have good reason to believe these terms are being broken. For clear abuse, such as sending to a purchased list, we act immediately and without notice.
Addresses that hard bounce or complain are suppressed, and they stay suppressed for your workspace.
6. Your data and your subscribers’ data
The contacts you import and the content you write stay yours. We use them to run the service for you and for nothing else: we do not sell them, and we do not email your contacts on our own behalf.
Under data protection law you are the controller of your subscribers’ personal data and we are your processor. It is your responsibility to have a lawful basis for emailing them and to answer their requests. What we do with personal data is described in our Privacy Policy.
You can export your data or ask us to delete it at any time by writing to axel.schapmann@gmail.com.
7. Connected accounts
When you connect Stripe or Supabase, you authorise Fromly to read the data those permissions cover, and to keep reading it until you disconnect. Access tokens are encrypted. Disconnecting stops the syncing; the contacts already imported stay in your workspace until you delete them.
8. Payment
Each account receives 1,000 email credits once, free of charge, when it is created. Beyond them, you buy email credits in advance through Stripe, at the price shown on our pricing page, and each email sent uses one credit, free or bought. Credits never expire and are shared across the workspaces you own.
If you turn on automatic recharge, you authorise us to charge your saved card the amount you chose whenever your balance falls below the threshold you set, up to the monthly limit you set. You can turn it off or change it at any time in your billing settings.
Credits are not refundable, except where the law requires it. If a payment is refunded or disputed, the credits it bought are removed from your balance.
Prices may change. A change never affects credits you have already bought, and we will tell you before it applies to automatic recharges.
Prices are exclusive of any tax we are required to collect.
9. Availability
We work to keep Fromly available and to deliver your emails, but we do not promise uninterrupted service. Some of it depends on providers we do not control, such as Amazon SES, Stripe and our hosting providers. Whether an email reaches an inbox is decided by the receiving provider, not by us.
The service is provided as it is, without warranties beyond those the law gives you and that cannot be excluded.
10. Liability
To the extent the law allows, our total liability towards you is limited to what you paid us in the twelve months before the event that caused the damage. We are not liable for lost profit, lost revenue, or lost or damaged data.
Nothing here limits liability that cannot be limited by law.
11. Ending the agreement
You can stop using Fromly and delete your account whenever you want. We can end the agreement with 30 days’ notice, or immediately if you break these terms, if your use puts our sending reputation at risk, or if you do not pay.
After an account is closed, its data is deleted. Export what you need first.
12. Changes to these terms
We may update these terms. If a change matters to you, we will tell you by email before it takes effect. Continuing to use Fromly after that means you accept the new version.
13. Governing law
These terms are governed by French law. If you are a consumer, you keep the protection of the mandatory rules of the country you live in, and you may bring a dispute before the courts of that country.
